About Email Newsletters, Mass Emailing and Spamming

You CANNOT use your ClientReady/ClientCart eBuilder mail service to do mass email marketing (otherwise know as 'spamming') without incurring serious risk.

IMPORTANT - PLEASE READ:
The single most important thing to know about any Mass Email you may send out is that IF a COMPLAINT is received, you will be liable, and possibly lose your site or at least, have to pay a fine of $250 - $500.

If you send email that generates a high number of complaints, you can LOSE YOUR SITE and will NOT be entitled to a REFUND.

What is Mass Emailing?
Any kind of group email that you send out is considered mass emailing.

What's the difference between Mass Email and SPAM?
The thing that is most important, is whether or not your email generates a SPAM complaint. THAT is the key issue. if your email doesn't generate a complaint then you're fine. But if it DOES, then you're liable for a hefty fine.

So in short, there's a very very fine line between what is considered SPAM and what is considered Mass Email.

Can someone that opted in to my mailing list still file a complaint?
Unfortunately, yes. They may have forgotten that they signed up for your newsletter, or maybe someone is pulling a prank on them. It doesn't matter, a complaint is a complaint.

What is considered SPAM?
Any email that you send out that generates a complaint is considered SPAM no matter how or why. A complaint is a complaint.

Will I get into trouble for sending unsolicited emails?
You won't go to jail, for a few complaints anyway, but SPAM laws are getting tougher and tougher each day. Our advice is to stay away from Mass Emailing and Spam.

How can I safely send Mass Emailings to potential clients or customers?
There is no 100% safe way to do it. BUT, if you want to do it, and cut your risk, follow these instructions:

  • Be sure to use the DOUBLE-OPT-In method of collecting email addresses from your site. This means asking the user to sign up, and then sending out an auto-generated email that asks them to confirm their desire to be included in your list.
  • Only use email addresses that you have collected yourself
  • Do not purchase email lists. These are almost always fraudulent lists.
  • Don't send the emails through your own web site gateway. Use a free to join third-party service such as VerticalReponse.com. You'll want a service like this anyway because managing opt-ins and opt-outs will drive you insane quickly, and it's just not worth it.

Spamming is illegal and if you plan to do Email marketing, you MUST DO IT THROUGH ANOTHER MAIL GATEWAY (service). You CANNOT send mass email marketing through your ClientReady web mail account or you will be subject to fines and your account may be terminated without a refund.

In other words, you need to sign up with a third-party email direct marketing company such as verticalresponse.com or sparklist.com to do your mass Email marketing.

The reason for this is that servers and web sites end up getting shut down when spamming complaints are received at our hosting facility. In order to prevent this we have a very strict anti-spamming policy. Even though a person may have signed up to receive email from your site, they may forget and complain anyway, which causes a spamming violation.

FAILURE TO COMPLY WILL RESULT IN TERMINATION OF YOUR ACCOUNT! THIS IS SERIOUS BUSINESS DUE TO THE INCREASINGLY RIGOROUS ANTI-SPAMMING LAWS. YOU WILL NOT BE ENTITLED TO A REFUND.

You may also be subject to fines starting at $250 if you use your ClientReady email accounts for mass email marketing! Just Don't Do It!

Common Misconception:

"If I collect email addresses at my web site then I can email to that list of people - and this is not spamming." THIS IS WRONG.

The reason is that sometimes the email addresses you have were not submitted by the email address owner... sometimes others submit email addresses that are not their own, and thus unwanted email can be mailed out.

Sometimes they forget that they signed up and file a complaint to the Hosting company - this can result in your site being SHUT DOWN and fines starting at $250 minimum. Needless to say, this is serious business.

Also, you should never purchase email lists from other sources. This will for sure cause you problems. Email lists many times contain addresses that have been used by other spammers, therefore you will only increase problems by using such lists.

FAILURE TO COMPLY CAN RESULT IN TERMINATION OF YOUR ACCOUNT!

YOU WILL NOT BE ENTITLED TO A REFUND.
